Let’s be real: how many times do you get to say a trucking company got sued because its driver spilled diesel on the highway and then ghosted the cleanup crew? That’s not just negligence — that’s highway littering with a side of corporate cowardice. And now, A&A Hauling, LLC — a company apparently based in Tennessee but operating in Oklahoma like it owns the interstate — is on the hook for over $25,000 because someone in their employ turned part of I-40 into a Slip ‘N Slide of fossil fuels.

So who are these players? On one side, we’ve got Sooner Emergency Service, Inc., Muskogee’s answer to environmental disasters that happen between exits. These are the folks who show up when something goes sideways on the road — chemical spills, wrecked tankers, you name it. They’ve got excavators, absorbent booms, off-duty state troopers on speed dial, and apparently enough paperwork to wallpaper a small courthouse. They’re not messin’ around. On the other side is A&A Hauling, LLC — a foreign corporation (meaning not from Oklahoma), possibly unlicensed to do business in the state, yet somehow still allowed to drive massive trucks full of diesel through the Sooner State like they’re playing real-life Big Rigs: Over the Road Racing. We don’t know much about them except they live in Jackson, Tennessee, and apparently believe in a “drive fast, leave a mess, deny all liability” business model.

Here’s how this whole fiasco went down. On February 20, 2025 — yes, the future, but bear with us — a driver working for A&A Hauling caused what the court documents delicately call an “environmental hazard” on eastbound I-40 at Mile Marker 218 in Sequoyah County. That’s trucker-speak for “he spilled diesel all over the highway.” Twelve yards’ worth, to be exact — roughly the length of a school bus laid flat across the asphalt. Not exactly Chernobyl, but enough to make driving through it feel like you’re auditioning for Mad Max: Fury Road. And unlike Furiosa, nobody called for cleanup. So who did? The state, of course — and they called Sooner Emergency.

Now, Sooner didn’t cause this mess. They weren’t even there when it happened. But thanks to Oklahoma law — specifically Title 47, Section 11-1110 — if you spill something dangerous on the road, you’re supposed to clean it up. If you don’t? The state can send in a cleanup crew and then go after you for the bill. That’s exactly what happened here. Sooner rolled in with traffic cones, arrow boards, and a marked Oklahoma Highway Patrol unit (because nothing says “proceed with caution” like a cop car with flashing lights), set up safety zones, took soil samples (twice — once before and once after cleanup, because the Department of Environmental Quality loves its paperwork), and then hauled out about 12 yards of diesel-soaked dirt using a CAT mini excavator and a John Deere skid steer. They even dropped some “Micro Blaze” premix — which sounds like an energy drink but is actually a hydrocarbon-eating substance — into the hole just to make sure nothing sneaky was left behind.

And they didn’t stop there. They came back on February 21, February 25, and again in April 2025 — because cleaning up diesel isn’t a one-and-done kind of deal. You’ve got to test, retest, replace soil, lay sod, and basically play highway gardener until the state says, “Yep, that looks normal now.” All of this, Sooner did — and all of it was done for the sole benefit of A&A Hauling, who, let’s remember, created the problem in the first place.

So why are we in court? Because Sooner sent the bill — a whopping $25,133.54 — and A&A Hauling said, “Nope. Not paying.” No explanation. No counteroffer. Just radio silence. So Sooner sued. Their legal argument is actually pretty straightforward: under Oklahoma law, if you spill something hazardous on the road, you’re responsible for cleanup. Period. There’s even a statute that says truckers must carry insurance specifically to cover these kinds of spills. And if they don’t pay? The company that cleaned it up can sue to get reimbursed. Sooner is also throwing in some legal garnish — claims based on “quantum meruit” (Latin for “you got a benefit, so you owe me money”) and “quasi-contract” (which means “even if we didn’t sign a deal, you still owe me because it would be unfair not to”). But at its core, this is simple: you made a mess, we cleaned it, now pay up.

And what do they want? $25,133.54 — which, let’s be honest, is not chump change. But when you break it down, it starts to make sense. The biggest chunk — $13,658.33 — was for removing the contaminated soil. That included heavy equipment rentals (excavators, roll-off trucks, specialized trailers), certified operators, off-duty troopers for traffic control, lab tests, and disposal fees at American Environmental Landfill in Sand Springs. Then there was $8,637.88 just to replace the soil and lay sod — because apparently, after you dig up a chunk of highway, you can’t just leave a crater and call it a day. You’ve got to make it look nice again. There’s even a line item for “photos and processing” — $50 — because, in 2025, you better document everything if you want to get paid. Oh, and don’t forget the 15% markup on subcontractor services — because even emergency response has its overhead.

Is $25k a lot for a diesel spill? Depends. If you’re a small business, yes. If you’re a trucking company hauling cargo across state lines, probably not — especially if you’re supposed to have insurance for this exact scenario. But here’s the kicker: A&A Hauling isn’t just refusing to pay. They’re not even showing up. At least, not in the documents we’ve seen. No answer. No defense. Just silence. Which makes you wonder: did they forget? Are they broke? Or do they just think they can blow off Oklahoma like it’s a toll booth they didn’t feel like paying?

Our take? This case is peak “you don’t get to make a mess and walk away” energy. The most absurd part isn’t the spill — truckers drop stuff all the time. It’s the sheer audacity of not paying for the cleanup. Imagine throwing your fast food wrapper out the window on the interstate and then ignoring the bill when the state sends a crew to pick it up. That’s essentially what happened here, just with diesel instead of fries. And Sooner Emergency? They’re not the villains. They’re the unsung heroes of roadside disasters — the ones who show up in the rain, in the dark, with excavators and hazmat suits, to fix problems they didn’t create. They deserve their money. Not just because the law says so, but because if companies like A&A Hauling keep getting away with this, soon no one will bother cleaning up after them at all. And then we’ll all be driving through diesel puddles like it’s the apocalypse.

Bottom line: pay your cleanup bills, A&A. Even if you’re from Tennessee. Especially if you’re from Tennessee.

IN THE DISTRICT COURT IN AND FOR MUSKOGEE COUNTY STATE OF OKLAHOMA SOONER EMERGENCY SERVICES, INC., Plaintiff v. A&A HAULING, LLC, a Foreign Corporation, Defendants. Case#: CJ-2025-484 PETITION COMES NOW, the Plaintiff, Sooner Emergency Services, Inc. (hereinafter “Plaintiff”), by and through its attorneys of record, Green Country Law Group, PLLLP, and for its cause of action against the Defendant A&A Hauling, LLC (hereinafter “Defendant”) states as follows: 1. Plaintiff is a domestic for-profit corporation with its principal place of business in Muskogee, Oklahoma. 2. Defendant is a foreign corporation which is, upon information and belief, not licensed to conduct business in the State of Oklahoma, yet engages in business in the State of Oklahoma. 3. Plaintiff has suffered, and continues to suffer, damages in Muskogee County. Jurisdiction and venue are proper herein. 4. On or about February 20, 2025, the Plaintiff was contacted at its principal place of business in Muskogee, Oklahoma, regarding a wreck and environmental spill on I-40 at Mile Marker 218, in Sequoyah County, Oklahoma. 5. Negligence of a driver employed by Defendant caused an environmental hazard covering approximately twelve (12) yards on I-40. 6. Although Plaintiff did not create this, Plaintiff fully remediated said hazard, to the sole benefit of the Defendant, and is entitled to be compensated for its work in cleaning up the hazard created by the Defendant. 7. The environmental hazard spanned twelve (12) yards and on I-40 and emergency cleanup services were required in accordance with 47 O.S. §11-1110, and other applicable laws. Plaintiff was dispatched to the scene to provide and conduct the necessary emergency cleanup, including but not limited to: traffic control, removal of the contaminated soil, disbursal of absorbents to collect the spilled materials, providing soil samples to the Oklahoma Department of Environmental Quality, and replacing the replacing the contaminated soil. 8. Plaintiff was required to return to the scene on February 21, 2025, February 25, 2025 and in April 2025 to continue the remediation process. 9. Oklahoma Statute, Title 47, Section 11-1110 states in relevant part: A. No person shall throw or deposit upon any highway any glass bottle, glass, nails, tacks, wire, cans or any other substances likely to injure any person, animal or vehicle upon such highway. B. Any person who drops, or permits to be dropped or thrown, upon any highway any destructive or injurious material shall immediately remove the same or cause it to be removed. [...] 2. Truck-tractors carrying cargo on the roadways of this state shall maintain a commercial auto, farm and ranch, inland marine or cargo liability insurance policy that covers the costs of cleanup of any substance that is spilled or otherwise deposited on the roadway or right-of-way in violation of this section. 10. Plaintiff provided the necessary emergency cleanup services on an open account, and the services, procedures and equipment utilized by Plaintiff in the February 20, 2025, February 21, 2025, February 25, 2025 and April 2025 cleanup are reflected in its invoices and statements attached hereto as Exhibit 1. 11. Plaintiff has demanded payment in the amount of $25,133.54 from the Defendant and the Defendant has refused or otherwise neglected to compensate Plaintiff for the services provided. 12. The Defendant is liable for the payment of the services provided by Plaintiff pursuant to the provisions of 47 O.S. §11-1110, and other applicable laws, and Plaintiff is entitled to judgment against the Defendant in the amount of $25,133.54, plus interest and costs. 13. Plaintiff is further entitled to recover the amount prayed for as a matter of law under the doctrines of contract, quasi-contract, and quantum meruit. WHEREFORE, premises considered, Plaintiff prays for judgment against the Defendant in the amount of $25,133.54, plus interest; that Plaintiff be awarded its attorney fees and costs incurred in the prosecution of this matter; and for such other relief determined to be just and equitable by this Court. Upon arrival on the scene traffic control was set up for the personal safety of the environmental control personnel and the motoring public. Bill Inhofe with Sooner Emergency Service contacted Oklahoma Highway Patrol Headquarters in McAlester and requested a State Trooper with a marked unit assigned to the site to control the traffic situation and provide safety measures to prevent further accidents at the site. This request was approved due to the contracts with the Department of Public Safety. SES, Inc. technicians set a traffic directional arrow board and reflective traffic cones in place to advise the motoring public of the situation as they approached the site. Protection of the motoring public along with the protection of the environmental control personnel was a priority. Before the contaminated soil was excavated soil samples were taken for the following lab tests: 1- Dirty BTEX, 1- Dirty TEX 1005 The contaminated soil caused by the diesel spill was removed utilizing a CAT Mini Excavator. A John Deere Skid Steer was used to transport the soil and then dumped into a roll off box. Approximately 12 yards of contaminated soil were removed and will be transported to an approved industrial landfill. Necessary soil samples as required by the Oklahoma Department of Environmental Quality were taken for the following lab tests: 1- Clean BTEX, 1- Clean TEX 1005 Lastly, premixed Mirco Blaze was poured onto the excavation site to remove any remaining hydrocarbons.
