Meet Jona Q. Cole. He lives in Collinsville, Oklahoma — not far from Claremore, where he walked into Suburban Chevrolet on March 28, 2023, and signed on the dotted line for a used pickup truck that, on paper, cost $36,300. He put down $1,000, financed $41,568 (somehow more than the cash price — don’t ask, it’s car sales math), and agreed to pay it back over seven years at 7.49% interest. That’s 84 payments of $639.37, which, if you do the math, totals over $53,700. For a used Sierra with 113,825 miles on it. But hey, that’s the American dream: freedom, the open road, and indentured servitude to a finance contract with a 5% late fee.

Jona didn’t make all the payments. We don’t know why — maybe money got tight, maybe the truck broke down, maybe he just decided the math wasn’t worth it. What we do know is that by June 12, 2025, Tinker Federal Credit Union — the lender that bought the loan from Suburban Chevrolet — had had enough. They sent someone to repossess the truck. Peacefully, one assumes. No dramatic car chases, no boots on the ground, just a repo guy with a tow truck and a clipboard showing up at 15126 E 121st Pl N. And just like that, the Sierra was gone.

Now, repossession isn’t the end of the story — it’s just halftime. The credit union had a legal obligation to sell the truck in a “commercially reasonable manner,” which sounds like corporate-speak for “don’t auction it off on Facebook Marketplace for $500.” So they did the thing: notified Jona (allegedly), waited, and on July 9, 2025, sold the truck for $17,600. That’s not nothing — it’s a decent chunk of change for a six-year-old work truck — but it’s also $23,968 short of what Jona originally owed, before interest and fees started piling up like unpaid parking tickets.

But wait — there’s more! The credit union didn’t just lose the principal. They lost time, effort, and legal fees. So they did what any self-respecting financial institution does: they calculated the remaining balance, subtracted the sale proceeds, added in interest, late fees, repossession costs, and attorney’s fees, and arrived at the grand total of $19,723.35. That’s what they’re suing for. And no, Jona, you can’t pay in trade-ins.

Now, let’s talk about the claims. The lawsuit says “breach of contract,” which, in normal person English, means: you signed a paper saying you’d pay us back, and you didn’t, so now we’re coming for what’s ours. It’s not flashy. It’s not complicated. It’s the financial version of “you broke the rules, now face the music.” But buried in the 15 pages of legalese is a clause that might make you side-eye your next car loan: the Arbitration Provision. By signing, Jona agreed that if there was a dispute, it wouldn’t go to court — it would go to binding arbitration, where a single arbitrator (probably not a jury of his peers, more like a guy in a suit hired by the system) would decide the outcome. And get this — he waived his right to join a class action. So even if 10,000 Oklahomans got screwed by the same loan terms, Jona’s stuck fighting alone. It’s like being handed a Nerf sword before a gladiator match.

Tinker Federal Credit Union isn’t asking for punitive damages. They’re not demanding Jona’s firstborn. They just want their money. $19,723.35. Plus interest. Plus attorney’s fees. Plus court costs. Is that a lot? For a used truck, maybe not — not when you consider that the total of payments was over $53,700. But for an average household in Rogers County? Yeah, that’s a year’s rent. That’s a down payment on a house. That’s a lot of “I’ll pay you back next month” promises.

And yet — here’s the most absurd part — none of this was avoidable. The credit union could have worked with Jona. They could have modified the loan. They could have offered a payment plan. But instead, they went straight to repossession, then straight to court, because that’s what credit unions do when the machine starts grinding. They don’t care about your sob story. They care about the bottom line.

Oh, and just in case you were wondering — no, Jona isn’t in the military. The credit union checked. They even filed an affidavit from Ashley Brintnall, Collections Legal Specialist, swearing under penalty of perjury that Jona Q. Cole is not on active duty, has not been in the last 367 days, and hasn’t received orders to be called up. That’s the Servicemembers Civil Relief Act in action — a little-known law that stops creditors from hammering active-duty troops. But Jona? He’s on his own.

So what’s our take? We’re not rooting for the credit union. They’re a faceless institution that made a risky loan and are now playing hardball. But we’re not exactly rooting for Jona either — unless he’s being crushed by medical debt or unemployment, in which case, sympathy might apply. But based on the filing? This looks like a guy who bought more truck than he could afford, stopped paying, and now wants to walk away clean. Newsflash: you can’t. That’s how credit works. That’s why your score tanks when you default.

The real villain here? The $4,560 “Service Contract” buried in the itemization — the one paid to “WWK ADMIN” — which sounds less like maintenance and more like a mystery fee designed to pad the loan. And the $1,200 gap contract. And the $498 documentation fee. These are the traps. This is how a $36,300 truck becomes a $41,568 loan before interest even kicks in.

So here we are. A man, a truck, and a debt that outlived the vehicle. The court will likely rule in favor of the credit union. Jona will owe nearly twenty grand for a truck he no longer has. And somewhere, in a cubicle in Oklahoma City, Jeffery S. Ludlam will file another win for the collection team. Another case closed. Another reminder: read the fine print. Or at least, don’t buy a car you can’t afford.

FEB 13 2026 CATHI EDWARDS, COURT CLERK DEPUTY PETITION Plaintiff, Tinker Federal Credit Union ("Plaintiff"), for its cause of action against the Defendant, Jona Q. Cole ("Defendant"), alleges and states as follows: 1. On or about March 29, 2023, Defendant executed a Promissory Note (hereinafter referred to as the "Contract"), and became obligated to pay Plaintiff the principal amount of $41,568.00, plus interest at 7.4900% per annum, according to the terms of the Contract. A copy of the Contract is attached hereto as Exhibit "A". 2. As part of the Contract and to secure the performance of Defendant, Defendant executed a Security Agreement and granted Plaintiff a security interest in a 2017 GMC SIERRA 15 (hereinafter referred as the "Collateral"). Plaintiff properly perfected its security interest in accordance with Oklahoma law. 3. Defendant failed to pay pursuant to the terms of the Contract, despite demand by Plaintiff, and is therefore in default under the Contract and Security Agreement. 4. On June 12, 2025, Plaintiff repossessed the Collateral. Plaintiff is entitled to a repossession title to the Collateral from the Oklahoma Tax Commission. 5. On July 9, 2025, the Collateral was sold for $17,600.00. Plaintiff complied with all notice requirements set forth by law. The sale was held in a commercially reasonable manner. 6. After deducting the net proceeds from the sale of the Collateral, the balance due on the Contract as of January 7, 2026 was $19,723.35. 7. Plaintiff is entitled to reasonable attorney's fees and its reasonable costs of collection under the terms of the Contract and Security Agreement and under 12 O.S. §936. 8. Pursuant to the Servicemember’s Civil Relief Act of 2003, Plaintiff has reviewed the Department of Defense website and determined Defendant is not in the military. See the Affidavit attached hereto as Exhibit “B”. 9. Pursuant to 40 O.S. §4-508(D), Plaintiff requests an Order that at any time or times subsequent to the filing of this order, the Oklahoma Employment Security Commission shall produce, within thirty (30) days of receipt of this order, employment information of the Defendant. WHEREFORE, Tinker Federal Credit Union, prays that this Court enter money judgment for Plaintiff and against Defendant, Jona Q. You agree to pay us all you owe under this contract even if the vehicle is damaged, destroyed, or missing. b. Using the vehicle. You agree not to remove the vehicle from the U.S. or Canada, or to sell, rent, lease, or transfer any interest in the vehicle or this contract without our written permission. You agree not to expose the vehicle to misuse, seizure, confiscation, or involuntary transfer. If we pay any repair bills, storage bills, taxes, fines, or charges on the vehicle, you agree to repay the amount when we ask for it. c. Security Interest. You give us a security interest in: • The vehicle and all parts or goods put on it; • All money or goods received (proceeds) for the vehicle; • All insurance, maintenance, service, or other contracts we finance for you; and • All proceeds from insurance, maintenance, service, or other contracts we finance for you. This includes any refunds of premiums or charges from the contracts. This secures payment of all you owe on this contract. It also secures your other agreements in this contract. You will make sure the title shows our security interest (lien) in the vehicle. You will not allow any other security interest to be placed on the title without our written permission. d. Insurance you must have on the vehicle. You agree to have physical damage insurance covering loss of or damage to the vehicle for the term of this contract. The insurance must cover our interest in the vehicle. You agree to name us on your insurance policy as loss payee. If you do not have this insurance, we may, if we choose, buy physical damage insurance. If we decide to buy physical damage insurance, we may either buy insurance that covers your interest and our interest in the vehicle, or buy insurance that covers only our interest. If we buy either type of insurance, we will tell you which type and the charge you must pay. The charge will be the premium for the insurance and a finance charge computed at the Annual Percentage Rate shown on page 1 of this contract. If the vehicle is lost or damaged, you agree that we may use any insurance settlement to reduce what you owe or repair the vehicle. e. What happens to returned insurance, maintenance, service, or other contract charges. If we get a refund of insurance, maintenance, service, or other contract charges, you agree that we may subtract the refund from what you owe. 3. IF YOU PAY LATE OR BREAK YOUR OTHER PROMISES a. You may owe late charges. You will pay a late charge on each late payment as shown on page 1 of this contract. Acceptance of a late payment does not excuse your late payment or mean that you may keep making late payments. If you pay late, we may also take the steps described below. b. You may have to pay all you owe at once. If you break your promises (default), we may demand that you pay all you owe on this contract at once. Default means: • You do not pay any payment on time; • You give false, incomplete, or misleading information during credit application; • You start a proceeding in bankruptcy or one is started against you or your property; or • You break any agreements in this contract. The amount you will owe will be the unpaid part of the Amount Financed plus the earned and unpaid part of the Finance Charge, any late charges, and any amounts due because you defaulted. c. You may have to pay collection costs. If we hire an attorney who is not our salaried employee to collect what you owe, you will pay the attorney's fee and court costs the law permits. The maximum attorney's fee you will pay will be 15% of the amount you owe, unless a court awards an additional amount. d. We may take the vehicle from you. If you default, we may take (repossess) the vehicle from you if we do so peacefully and if the law allows it. If your vehicle has an electronic tracking device (such as GPS), you agree that we may use the device to find the vehicle. If we take the vehicle, any accessories, equipment, and replacement parts will stay with the vehicle. If any personal items are in the vehicle, we may store them for you. If you do not ask for these items back, we may dispose of them as the law allows. e. How you can get the vehicle back if we take it. If we repossess the vehicle, you may pay to get it back (redeem). We will tell you how much to pay to redeem. Your right to redeem ends when we sell the vehicle. 1. We will sell the vehicle if you do not get it back. If you do not redeem, we will sell the vehicle. We will send you a written notice of sale before selling the vehicle. We will apply the money from the sale, less allowed expenses, to the amount you owe. Allowed expenses are expenses we pay as a direct result of taking the vehicle, holding it, preparing it for sale, and selling it. Attorney fees and court costs, if the law permits, are also allowed expenses. If any money is left (surplus), we will pay it to you unless the law requires us to pay it to someone else. If money from the sale is not enough to pay the amount you owe, you must pay the rest to us unless the law provides otherwise. If you do not pay this amount when we ask, we may charge you interest at a rate not exceeding the highest lawful rate until you pay. g. What we may do about optional insurance, maintenance, service, or other contracts. This contract may contain charges for optional insurance, maintenance, service, or other contracts. If we demand that you pay all you owe at once or we repossess the vehicle, you agree that we may claim benefits under these contracts and cancel them to obtain refunds of unearned charges to reduce what you owe or repair the vehicle. If the vehicle is a total loss because it is confiscated, damaged, or stolen, we may claim benefits under these contracts and cancel them to obtain refunds of unearned charges to reduce what you owe. 4. SERVICING AND COLLECTION CONTACTS In consideration of our extension of credit to you, you agree to provide us your contact information for our servicing and collection purposes. You agree that we may use this information to contact you in writing, by e-mail, or using prerecorded/artificial voice messages, text messages, and automatic telephone dialing systems, as the law allows. You also agree that we may try to contact you in these and other ways at any address or telephone number you provide us, even if the telephone number is a cell phone number or the contact results in a charge to you.
