So who are these people? On one side, we’ve got Christopher Brogdon, a regular dude living in Sand Springs, Oklahoma—population: 20,000, vibes: “I just want to live my life without getting sued.” He opened a credit card with Credit One Bank back in November 2022, probably for groceries, gas, or that one Amazon impulse buy we all regret at 2 a.m. The card had a $1,000 limit, which he blew past like it was a suggestion, not a boundary. By January 2024, his balance had ballooned to $1,719.09 thanks to interest (29.24% APR—yikes), a $39 late fee, and the cruel mathematics of minimum payments. Then, like so many Americans, he stopped paying. The account was “charged off,” which is banker-speak for “we’ve given up and are selling your debt to the financial equivalent of vultures.”

Enter the plaintiff: LVNV Funding LLC. Sounds legit, right? Feels like a real company with offices and spreadsheets and maybe even a coffee machine. But here’s the twist—LVNV isn’t the original lender. It’s not even the second or third. It’s the final stop on a debt collection relay race that looks like it was organized by a spreadsheet with commitment issues. The debt bounced from Credit One Bank to MHC Receivables, LLC, then to FNBM, LLC, then to Credit Asset Sales LLC, then to Resurgent Acquisitions LLC, and finally—drumroll—LVNV Funding LLC, which now sues Brogdon like it personally raised this debt from infancy. It’s like the debt was passed through a financial game of hot potato, and LVNV lost the game by being the one left holding it when the music stopped.

The story of what happened is, frankly, the story of modern American capitalism. Brogdon used a credit card. He didn’t pay it. The bank wrote it off. The debt was sold—probably for pennies on the dollar—to a series of shadowy financial entities whose entire business model is buying up defaulted debt and then suing people to get some of it back. LVNV, backed by the law firm Nelson and Kennard, LLP (shoutout to attorney Ashton Dewayne Sears, OBA #35737, who’s out here filing these all day), claims Brogdon breached his contract by not paying. That’s the legal term for “you agreed to pay, and you didn’t.” The filing is dry, robotic, and full of legalese, but the subtext is clear: we own this debt now, and we want our $1,656.59—plus court costs, fees, and whatever else the judge might toss in.

Why are they in court? Because, legally, this is how debt collection works when you’re not paying. LVNV is suing for breach of contract—basically saying, “You signed up for this card, you spent the money, and now you’re on the hook.” It’s not about fraud, theft, or identity issues. It’s a straightforward “you owe money, we own the debt, pay up” case. And in theory, that’s simple. But the real story is in the paper trail: a debt that changed hands five times in a month, each transfer documented with the solemn gravitas of a royal decree, even though it’s just one guy’s credit card bill being auctioned off in the digital backrooms of financial capitalism.

And what do they want? $1,656.59. That’s it. Not millions. Not even five figures. Just over sixteen hundred bucks. Is that a lot? For a debt collection firm, maybe not—they’re playing the volume game, suing hundreds of people at once, hoping most don’t show up and they win by default. But for Christopher Brogdon? That’s two months of rent in Sand Springs. That’s a major chunk of a paycheck. And now he’s got to either pay it, fight it, or ignore it and risk a default judgment that could wreck his credit even more.

Here’s the kicker: the last payment Brogdon made was $62.50 on May 23, 2024—after the account was charged off and sold through four companies. So either he didn’t know the debt had been sold (common), or he thought he was still paying Credit One Bank (also common), or he just kept tossing money into the void hoping it would go away. But LVNV says that payment doesn’t count toward their claim, because they didn’t own the debt yet. That’s how this works: you pay, but the payment vanishes into the corporate abyss, like sending a letter to a P.O. box that’s been abandoned since 2019.

Our take? This case is a perfect microcosm of how broken the American debt collection system is. A man racks up a modest credit card balance, misses payments, and suddenly his financial ghost gets auctioned off to the highest bidder in a chain of LLCs that exist solely to litigate. The original bank walks away, the debt gets stripped down and repackaged, and some faceless entity in Delaware sues a guy in Oklahoma for a number that keeps changing. And for what? A grand total of $1,656.59? The legal fees for this case probably cost more than the debt itself.

We’re not saying Brogdon doesn’t owe the money. We’re not saying credit card debt should be forgiven. But come on—this process is Kafkaesque. It’s not justice. It’s financial whack-a-mole. And the most absurd part? LVNV Funding LLC doesn’t care about Christopher Brogdon as a person. They don’t know his story. They don’t care if he lost his job, got sick, or just made a dumb choice. Plaintiff’s claim arises when the Defendant(s) opened a credit account and failed to make the required monthly payments as agreed. The credit account charged off for non-payment on 1/24/24, the balance due at time of default is as follows $1,719.09. A true and accurate copy of the last periodic statement provided to the Defendant(s) prior to charge-off is attached hereto as Exhibit 1. A true and accurate copy of the ownership of the credit card account is attached hereto as Exhibit 2. 5. The Defendant(s) breached the Contract by failing to make the required periodic payments. 6.
