PETITION
COMES NOW the Plaintiff, by and through counsel, Nelson and Kennard, LLP, and herewith alleges the following and seeks redress as hereafter delineated.
1. Plaintiff is a national debt collection agency, which transacts business within the State of Oklahoma.
2. Venue is proper in this County, as the Defendant(s) reside(s) in this County at the commencement of this action, or the contract which is the subject matter of this action was made, executed, and delivered in this County.
3. The last four (4) digits of the Defendant’s account number, used by the original creditor as of the date of default are XXXXXXXXXXXXX9655.
4. Plaintiff's claim arises when the Defendant(s) opened a credit account and failed to make the required monthly payments as agreed. The credit account charged off for non-payment on 12/29/23, the balance due at time of default is as follows $521.20. A true and accurate copy of the last periodic statement provided to the Defendant(s) prior to charge-off is attached hereto as Exhibit 1. A true and accurate copy of the ownership of the credit card account is attached hereto as Exhibit 2. A true and accurate copy of the Terms and Conditions of the account is attached as Exhibit 3.
5. The Defendant(s) breached the Contract by failing to make the required periodic payments.
6. As a direct and proximate result of the Defendant(s) default, the total amount of debt claimed is $521.20.
7. The date of the last payment made by the Defendant(s) is April 20, 2023.
8. Plaintiff seeks court costs, and for such further relief as the Court may deem proper in the premises.
WHEREFORE, Plaintiff, PORTFOLIO RECOVERY ASSOCIATES, LLC prays for judgment against the Defendant(s), PAIGE JENKINS in the amount of $521.20, plus all costs herein expended, including but not limited to, court costs, sheriff’s fees, and special process server fees, attorney fees; and for such other and further relief as the Court may deem proper in the premises.

How We Will Calculate Interest.
We calculate interest separately for each type of balance (for example, Purchases at the current rate different promotional balances, collectively "Type of Balance"). Your monthly billing statement shows each Type of Balance on your Account.
We calculate a daily balance for each Type of Balance each day. We start with the balance as of the end of the previous day. We add any interest calculated on the previous day's balance. (This means interest is compounded daily.) We add any new Purchases to the appropriate Type of Balance, subtract any applicable new payments or credits, and make other adjustments. A credit balance is treated as a balance of zero. We then multiply each daily balance by the applicable DPR. We do this for each day in the billing cycle to get the daily interest. The total of all the daily interest for all the daily balances equals the total interest for the billing cycle. If we charge interest, but the total interest is less than the Minimum Interest Charge we will charge you the Minimum Interest Charge instead.
Accrual of Interest and How to Avoid Paying Interest on Purchases. Your due date is at least 23 days after the close of each billing cycle. On Purchases, interest begins to accrue as of the transaction date. However, you can avoid paying interest if you pay your Purchases subject to interest (excluding Easy Pay Offers) plus any monthly Easy Pay Payment Amount in full by the Payment Due Date every month.
If you do not pay your Purchases subject to interest (excluding Easy Pay Offers) plus any monthly Easy Pay Payment Amount by the due date each month, you will pay interest on those purchases from the date they are posted to your account until the date you pay those Purchases in full. When those Purchases (excluding Easy Pay Offers) are paid in full your next statement will include interest accrued from the first day of that statement period until the date your payment in full was received.
Purchases that are enrolled in an Easy Pay Offer will be charged interest in accordance with the plan as disclosed at enrollment.
If you have Purchase balances with a 0% promotional APR, you can avoid paying interest on those Purchase balances during the promotional period. (However, to avoid a late fee, pay at least your Minimum Payment Due.)

CARDMEMBER AGREEMENT
This Agreement establishes the terms of your credit card account ("Account") with Barclays Bank Delaware in Wilmington, Delaware. Please review this Agreement carefully before signing. If you have signed another agreement, but plan to use the back of your credit card (the "Card"), if you have not already done so. All extensions of credit in connection with your Account are being made by Barclays Bank Delaware.
Using Your Account/Acceptance of These Terms
You may use your Card at our stores located in Wilmington, Delaware, Old Navy, Benেne Republic or Athlete retail, online or Outlet/Factory stores located in the U.S. and Puerto Rico. You do not need to accept the Card nor this Agreement and none of the fees on this Account except as noted hereunder (such as Annual Fees) will be charged until you indicate acceptance by making a purchase or charging an amount to your Account. Thereafter, your Card is accepted for use and this Agreement becomes binding upon you. The Cardmember Table to determine if the Account has An Annual Fee and provided that you have not otherwise used the Account to make a purchase or deposit of funds during the prior 12 month period ending June 30th of the current year. By using your Card, you agree to be bound by this Agreement. The Card is not valid for cash advances or balance transfers. If you return the back of your Card, and if you do, you will not be responsible for paying the Annual Fee. By charging purchases to your Account, you authorize Barclays Bank Delaware to debit such charges directly from your Account. If a transaction on the Card is unauthorized, notify Barclays Bank Delaware immediately. If you obtain credit in the form of Purchases by using your Card, you are subject to the terms of the Cardmember Agreement. If your Card is lost or stolen, contact Barclays Bank Delaware immediately to stop further transactions. If you exceed your credit limit on your Account, you agree that you will not use your Card or Account in which you have exceeded your credit limit until the entire excess is paid in full. If you dispute any charge on your Account, contact us immediately. Please note that the charge is uncollectible on the grounds the transaction was prohibited or unauthorized. The Card must be returned to us upon request. This Card is not valid outside of the U.S. and Puerto Rico.
Definitions:
It is possible that capitalized term in this document but we do not define the term in this document, the term has the meaning as used in your monthly statement.
"Agreement" means this document and the Account Summary Table, and any changes we make to this document, from time to time.
"Authorized User" means any person you allow to use your Account including without limitation through a Card, the account number, online or telephone access, or any other means.
"Purchases" means the use of your Card or account number to buy or lease goods or services. Purchases include Account Fees and any applicable Interest Charges.
"You" and "your" refer to each person who has applied for, accepted, or used the Account and each person who has agreed to be responsible for the Account.
"We," "us," or "our" refer to Barclays Bank Delaware, unless separately defined herein. It is expressly acknowledged that the definition of "we," "us," or "our" in this Arbitration Section below, is governed by the definitions set forth in that provision.
Easy Pay Settlement Offer
From time to time we may at our option, make certain special promotional offers available for certain types of Purchases. ("Easy Pay Offer"). For Further Details, see the Cardmember Agreement Summary Table and the following paragraphs.
For Easy Pay Offers, the minimum payments during the repayment period are reduced by deducting the promotional Purchase amount from the regular minimum payment. Payments are made by charging the promotional Purchase Amount to the Card or Account number. For example, if your purchase amount is $500.00 and your APR is 28%, your minimum payment will be reduced from $140.00 to $60.00 per month for six months. Your minimum payment under the applicable Easy Pay Payment Term (each an "Easy Pay Payment Amount").
Each Easy Pay Payment Amount shall be subject to the then current non-promotional APR. Any remaining balance not paid in full by the end of the repayment period will accrue interest under the then current non-promotional APR.
If you do not make each required Easy Pay Payment Amount on time during the repayment period and/or there is a remaining Easy Pay Balance owed, then the remainder of the remaining Easy Pay Balance (if any) will (a) be subject to the then current non-promotional APR for Purchases on the Account and (b) be subject to the then Easy Pay Offer Minimum Payment Due. If you do not make each required Easy Pay Payment Amount on time during the repayment period and/or there is a remaining Easy Pay Balance owed, then any remaining balance not paid in full by the end of the repayment period will accrue interest under the then current non-promotional APR.
We reserve the right in our sole and absolute discretion to reject any Easy Pay Offer.
Easy Pay Offer:
Obligations on Your Account.
You may not assign or transfer your Account for all Purchases made or obtained by you or anyone you authorize to use your Card or Account number, unless you notify us in writing at least 30 days before the date of such sale or assignment. We may require that you acknowledge the terms of the Agreement, whether resulting from (1) physical use of your Card, (2) mail order or telephone, (3) internet or online transaction, (4) electronic or mobile device, or (5) any other method of payment, that you will not be entitled to any charge, or authorize someone else to make a charge, to your Account. Each person who has agreed to be responsible on the Account is equally responsible for prompt payment of all charges owed on the Account to the extent allowed by law. You must pay your bill promptly. We may require that you pay the full amount owed without first seeking any other persons to pay. Instructions for making payments and other information are on your monthly statement. If you notify us that you are unable to pay, the last date we may refuse, including the times of receipt, will be credited as of the business day they are received. Payments must be marked on the face of the check or money order and enclosed with your payment. Checks and other instruments for payment must be drawn on a U.S. bank in U.S. funds. If checks are delivered via overnight delivery, the funds will be available to your Account within two business days from the date of delivery of your payment. All payments must be made in U.S. dollars. Any payment made by check or other negotiable instrument will be subject to customary collection procedures. If you pay in foreign currency, we may convert the payment into U.S. dollars based upon the exchange rate set by your bank at the time of payment. If we do not know the foreign currency rate, we will select the foreign currency rate at our discretion. To ensure the funds from the bank are credited to your Account, we may not credit your payment until up to seven (7) days after posting of payment. If we fail to receive payment for up to seven (7) days after posting, we may charge interest and fees to your Account and we may report the payment for up to seven (7) days after the payment posts to the account. If you owe any fees, the payment will post to your Account as soon as possible.
Minimum Payment Due
Minimum Payment Due is the amount due on your Account determined in accordance with the terms of this Agreement.
Variable Rate Information
The Annual Percentage Rate (APR) on your Account that is used to determine the amount of interest to be charged for Purchases is a variable rate. The APR on your Account corresponds to a daily periodic rate ("DPR") and is calculated by multiplying the statutory Prime Rate published in the Money Rates column of The Wall Street Journal on the last business day of each month by the applicable margin (the difference between the DPR and the prime rate). For example, if the statutory Prime Rate equals the minimum percentage rate of 36 percent. That rate plus included in connection with the credit transaction; any application fee charged (other than a balance transfer fee) will not be included in connection with the credit transaction; any deferred interest charges that occur on a deferred interest card account. To receive this information and a description of your payment obligation orally, please call 888-640-9074. If the statutory Prime Rate exceeds the minimum percentage rate of 36 percent, the consumer's legal rights may be affected by this change. If Military Lending Act nothing in this agreement will be deemed a waiver of the right to legal recourse under any otherwise applicable provisions of law affecting military personnel.
Monthly Billing Statements
Each month, a monthly billing cycle statement will be mailed or delivered to you if your Account has a debit or credit balance of more than $1.00 or if interest or a fee have been assessed. We will send out a monthly billing statement if we deem your Account uncollectible and/or if a collection agency has been retained or if collections are being instituted by us sending your Account to an outside collection agency or attorney for collection.
Your Minimum Payment Due Each Month
Each billing cycle, you must pay at least the Minimum Payment Due shown on your monthly statement by its Payment Due Date. We will apply payments as follows:
(1) If the Statement Balance is less than $30, the Minimum Payment Due equals the Statement Balance shown on your monthly statement.
(2) If the Statement Balance is $30 or more, the Minimum Payment Due equals the greater of $30 or the total of:
• Any interest charges billed on the monthly statement (excluding any Interest charges that accrued on a deferred interest card account).
• Any late payment charges.
• Any finance charges.
• Any minimum payment charges.
• Any other charges.
In addition, if your Account has one or more Easy Pay Balancer(s), your Minimum Payment Due will include:
• Any past due Easy Pay Payment Amount(s).
Authorized Users
You can designate an Authorized User to use your Account. When you tell us to add an Authorized User to your account, you are confirming that you have a relationship with the person or persons that information is correct, and that the Authorized User has agreed to be bound by this Agreement. The Authorized User agrees to comply with all terms of this Agreement, including, but not limited to, the repayment of amounts charged to the Card and compliance with the limits imposed by the Cardmember Agreement Summary Table. We will send notice of any information regarding the authorized user account to the primary account holder.
Default/Collection Costs.
Unless otherwise required by law, your Account will be in default and we may demand immediate payment of the entire amount you owe us if: (i) in any month we do not receive your Minimum Payment Due by the Payment Due Date; (ii) you make Purchases in excess of your credit limit; (iii) we are unable to verify your identity; (iv) we reasonably believe that the payment or performance of your obligations under this Agreement is impaired; (v) we have reason to believe that you are insolvent or in bankruptcy; (vi) we receive notice that we are requested to take any action against you; (vii) you breach this Agreement (including court or arbitration costs and the fees of any collection agency to which we refer your Account) and, in the event of such default, we may charge reasonable attorney fees and collection costs to your Account. You will also be responsible for the reasonable fees of such attorney. We will not be obligated to honor any attempted Use of your Account if a default has occurred or we have suspended your Account.
Termination/We May Suspend Or Close Your Account.
We may close or suspend your Account if you fail to pay when due or we reasonably believe that you are or may become insolvent or unable to pay your obligations under this Agreement. If we so decide, we will notify you and any Authorized Users of our decision by mail, fax or telephoning you at the number on file. If we close your Account for non-payment, we may retain the right to use your account without prior notice, even if you owe us less than $1.00. If we decide to terminate your right to use your account without prior notice, your obligations under this Agreement will continue even after the Account is closed.
Billing statements and notices will be sent to the address listed on our files. If this is a Joint Account, we will send billing statements and notices to each account holder and any authorized user. If you change your address, please notify us in writing. You may update this information by visiting the website on the back of your Card or sending an e-mail or telephoning us at the number printed above. We may send any notice required or permitted hereunder by posting it, in our sole discretion, on our websites.
Skip Payment Program and Other Special Terms.
From time to time, we may offer a program allowing you to skip one or more monthly payments during a year (interest will continue to accrue) or offer you other special features. If we do, we will advise you of the scope and duration of the applicable skip or special feature. When the skip or special feature is offered, it may affect the minimum payment due requirement.
Changes to this Agreement.
We may change the APR, fees, and other terms of this Agreement, including the annual percentage rate and any fees, as permitted by applicable law. These changes may include the addition or deletion of provisions relating to your Account or to the nature, extent, and enforcement of the rights and obligations described herein. Any such changes will apply to the balances on your Account as of the effective date of such change, unless the change applies only to future transactions. If applicable, the new terms of this Agreement will be effective at the time stated in our notice and will apply to those balances. In addition, if you are enrolled in our credit performance tracking program, any such changes will also apply to any related credits, even if not applicable to your Account balance at that time.
Credit Performance Tracking.
Your credit history will be established based upon criteria which reflect your particular credit history. We will from time to time review your credit history and inform you in advance of any changes. We may not be able to maintain your historical credit level. We may change your credit level or stop offering the program entirely. If we do, we will inform you in writing. We will only notify you as provided in this Agreement and in accordance with state or federal law.
Credit Information.
Verifiable information about your account will be reported to major credit reporting agencies in connection with your application and the administration of your Account. You can authorize us to provide information about your Account to third parties, including employment and income data, but this is optional. From time to time we may request employment and income data from such parties for the ongoing administration of your Account.
Call Center:
In the regular course of our business, we may monitor and record phone conversations made or received by our employees or our agents to ensure compliance with our policies and procedures, detect fraud, or improve our services. If you have questions, you agree that we will have such right with respect to all phone conversations, e-mail or conversations between you and our employees or agents. We may disclose such information to other Barclays Bank Delaware employees or affiliates, including call centers, directly or through an agent, for example, to collect amounts owed on the Account, to notify you of potential fraudulent transactions on your Account, or when necessary to protect our interests. We may also disclose such information, including mobile numbers, to third parties if we are required to do so by law, or if necessary in connection with our business. We may also disclose such information to our debtors, including servicers and collection agents, regarding the Account or your related financial obligations.
You consent to receipt of calls, from us or on our behalf, may be made:
(1) through telephone calls, from us or on our behalf, to the number you provided on the Account application;
(2) to any telephone number(s) that you later provide to us, endorsement, or to which we are authorized to dial;
(3) other communications, including mobile text messages, may be sent to the same telephone number(s) (technology permitting);
(4) by automated telephone equipment, including by the use of pre-recorded messages, voice response devices, and interactive voice response systems, and by other communication technologies, including caller ID, electronic messaging and computer or electronic mail;
(5) except to the extent prohibited by applicable law, other communications, including, but not limited to, fax or telecopier, Internet, U.S. mail and nontrollable email messages may be sent to you.
2 Consent to Receive Electronic Notices.
You may receive periodic billing statements and other notices regarding your Account electronically or by U.S. mail. By requesting electronic notice, you authorize us to send you any electronic communication related to your Account that otherwise we would be required to send by paper mail. We will provide to you one statement per statement cycle if you request it. If you request electronic notice, you may still receive some information in paper form, such as a new card or changes to your terms of use. Irregular Payments and Delay in Enforcement
We may waive any default or delay in enforcing any right or remedy we have under this Agreement or any other agreement for payment, without waiving any of our rights under this Agreement or any other agreement. Nothing in this Agreement nor any terms hereunder requires us to notify you prior to the time when we exercise any such right or remedy.
Our Right to Continue Collection Efforts
Our failure or delay in exercising any of our rights under this Agreement does not mean that we are unable to exercise those rights later.
Electronic Payment Conveniences
If you make a payment on your Account utilizing a check, you authorize us either to use the information from your check to make a transfer directly into your account or to process your payment as a check transaction. When we use information from your check to make an electronic fund transfer into your account or to process your payment as a check transaction, you may be charged a fee for the transaction, which is based on the amount of the transaction plus any applicable fees assessed by your financial institution for the transfer of funds. Any such charges will appear on the back of your Account statement.
If a payment you make is not honored by your bank and we have already credited your account for the payment, we will reverse the credit and charge your Account the amount of the non-honored payment plus any applicable fees assessed by your financial institution for the transaction.
Payment Allocation
Subject to mandatory provisions of applicable law, in most instances we will allocate any amount over your minimum payment to the highest APR balance first. Payments up to the minimum payment will be applied to the balances according to the order indicated. Payment Amount will be applied first to Easy Pay Balances.
Lost Cards
If your Card is lost or stolen or if you have reason to think someone may use your Account without your permission, you must notify us at once. You may notify us in writing at Barclays Bank Delaware, Attn: Lost Card Replacement, 601 North Market Street, Wilmington, DE 19801 (Attn: Lost Card). Alternatively, you may notify us at Barclays Barclaycard USA, Attn: Lost Card Replacement, P.O. Box 57040, Wilmington, DE 19857-0040. In addition, you should notify your primary bank or credit union and any other card issuer to whom you make any such assignment or sale shall be entitled to all of our rights under this Agreement, to the extent assigned.
Governing Law
STATE OF DELAWARE AND YOUR ACCOUNT WILL BE GOVERNED BY THE LAWS OF THE STATE OF DELAWARE AND, AS APPLICABLE, FEDERAL LAW.

We want you to be satisfied with our products and services. If you have a concern about one of our products or services, we encourage you to tell us. If you have complaints about our products or services or believe we have not handled your concerns properly, you may file a complaint with the Federal Trade Commission at www.ftc.gov/complaint or by calling 1-877-FTC-HELP (1-877-382-4357).
Arbitration
This ARBITRATION PROVISION DOES NOT APPLY TO YOU IF YOU ARE SUBJECT TO THE PROTECTIONS OF THE MILITARY LENDING ACT
This arbitration provision provides for binding arbitration of all Claims by either you or us against each other if either you or we choose to refer the Claim to arbitration. The term "Claim" means any claim, dispute, controversy, or cause of action between you and us arising out of or relating to this Agreement, your Account, any transaction or activity of your Account, any advertisement, or any goods or services described herein, or any subsidiary brand(s) including (without limitation) claims, disputes, or controversies based on non-tortious, non-commercial, or non-intentional conduct involving you or us. All issues shall be for the arbitrator to decide except issues related to the scope, enforceability, or interpretation of this arbitration provision. This arbitration provision cannot be modified by a statement or representation made to you by anyone other than Barclays Bank Delaware or related entities. If you do not agree with the following terms, you should stop using your Account at once and return your Card to us. The arbitration provision below does not apply to Claims involving more than $75,000, but any amount less than $75,000 may be arbitrated only. Barclays Bank Delaware and related entities retain the right to file suit for Claim amounts less than $75,000 in federal or state court, provided Barclays Bank Delaware files such suit before commencement of trial. Alternatively, you or we may pursue a claim, through a small claims court, for the equivalent amount in your home jurisdiction, provided the action remains in that court, is made on behalf of or against only you, is not subject to judicial consolidation or joinder of any other Claimant, and is pursuant to a preexisting agreement between you and Barclays Bank Delaware. If you proceed by arbitration, Barclays Bank Delaware and related entities may pursue a Claim, with respect to which arbitration has not been selected, through litigation. Any arbitration proceeding shall be stayed pending determination of the Claim in the event of resolution of a Claim in favor of either party to the arbitration proceeding.
TO LITIGATE OR TO CLAIM IN COURT: ARBITRATION YOU AND WE WILL NOT HAVE THE RIGHTS THAT ARE PROVIDED IN COURTS OF LAW, INCLUDING THE RIGHT TO A JURY TRIAL, THE RIGHT TO JOIN OTHER CLAIMANTS FOR CLASS ACTION SUITS, THE RIGHT TO DISCOVERY AND THE RIGHT TO APPEAL SECURITY INTERESTS. THIS ARBITRATION PROVISION SHALL NOT APPLY TO CLAIMS INVOLVING MORE THAN $75,000.
If any Claim is advanced in court, arbitration may be elected by notice to Barclays Bank Delaware, and the right to elect arbitration shall not be denied by a court. Both you and Barclays Bank Delaware are permitted to commence arbitration at any time after you or we notify Barclays Bank Delaware at Barclays Bank Delaware, P.O. Box 8601, Wilmington, DE 19801, that you or we intend to elect arbitration. Upon receipt of such notice, Barclays Bank Delaware will promptly notify you in writing. If you are served with a summons or other documents in connection with arbitration, you may not take part in the arbitration unless you request Barclays Bank Delaware in writing not later than 30 days after receipt of such documents, that you do not wish to participate in the arbitration. Barclays Bank Delaware will then notify you of its intent to arbitrate the Claim. If you do not respond within 30 days, Barclays Bank Delaware will notify both you and the administrative agency of your election to arbitrate. The arbitration may be conducted in person, by telephone, or based on documents submitted by both parties. If Barclays Bank Delaware initiates arbitration, Barclays Bank Delaware will be the moving party. The Claim will be heard before a single arbitrator. The arbitrator will be selected by you and Barclays Bank Delaware. Within 30 days after selection, the arbitrator shall notify both parties of the name and contact information for the arbitrator. Barclays Bank Delaware and related entities shall comply with the AAA's Optional Arbitration Rules ("Appellate Rules") within 30 days of the date of the Notice of Appellate Jurisdiction (as defined in the Appellate Rules). In no event will the arbitrator award be determined by a court. For purposes of dispute resolution, if you elect arbitration, your account shall remain subject to Barclays Bank Delaware's Terms and Conditions. Barclays Bank Delaware reserves the right to determine whether a Claim is subject to arbitration. Your rights under the Appellate Rules do not limit your ability to seek relief in federal or state court, provided that you do not use such courts to challenge the binding effect of the arbitration award. Your rights under the Appellate Rules do not limit your ability to seek enforcement of a binding arbitration award through litigation. Barclays Bank Delaware reserves the right to notify another entity about a Claim, even if you elect arbitration. If Barclays Bank Delaware determines that another entity has a claim against you or your Account, Barclays Bank Delaware will notify you of such claim and you may elect arbitration of your Claim. If both you and the claimant are eligible to arbitrate, the arbitration proceeding may be conducted and the award rendered in a combined proceeding, or separately, at the sole discretion of Barclays Bank Delaware. Any Claim, which may be resolved by arbitration, shall be resolved solely through arbitration, except as provided in the Appellate Rules.
