Insurance giant State Farm is being accused of a six-month bureaucratic shell game that left a man with a burned-out Range Rover and less than $7,000 in his pocket — despite the vehicle being worth over twice that. And no, we’re not talking about some clunker. We’re talking about a 2014 Range Rover Autobiography, the kind of SUV that says “I’ve made it” — or at least, “I’ve spent a lot of money trying to look like I have.”

Meet Ryan Hudspeth, a regular guy from Jones, Oklahoma, who just wanted his insurance company to do what insurance companies are supposed to do: pay up when disaster strikes. In May 2025, Hudspeth’s luxury SUV — fully insured through State Farm — caught fire and was declared a total loss. That part wasn’t in dispute. What is in dispute is what happened next: a slow-motion nightmare of delays, contradictory claims, and a valuation so low it borders on insulting.

At first, State Farm didn’t even acknowledge the vehicle was totaled. For six months — from May to November — the company insisted the Rover could be repaired. Never mind that it had been on fire. They sent Hudspeth two checks totaling over $12,000 under separate claim numbers, supposedly for repairs. So, like any reasonable person would, he paid $6,400 of that to a repair shop. But here’s the kicker: the shop quickly realized the car was not fixable. It was a smoldering hulk of British engineering. So Hudspeth did the only thing he could — he kept the remaining $5,700, figuring it was his to hold until the claim was settled.

Then came the twist. In November, after half a year of pretending the car wasn’t totaled, State Farm finally admitted defeat and issued a formal total loss valuation — but not before outsourcing the math to CCC Intelligent Solutions, a third-party data firm whose name sounds like a robot from a dystopian future. Their report valued the Rover at a base of $16,175, then slapped on a $2,000 deduction for “prior damage” — a deduction Hudspeth says is made up out of thin air. After some minor adjustments, the final “adjusted value” landed at $15,201. Not bad, right? Except Hudspeth’s own research — and common sense — says the retail replacement value was over $22,000. That’s a difference of nearly $7,000 that State Farm allegedly tried to save by gaming the system.

But wait — it gets worse. In a December 2025 letter (Exhibit B, because of course it’s Exhibit B), State Farm dropped the hammer: they weren’t just undervaluing the car — they were demanding money back. They deducted the $12,000 they’d already paid him for repairs — repairs they had authorized while insisting the car wasn’t totaled — and offered Hudspeth a grand total of $6,983.76 for the entire ordeal. Let that sink in. A six-figure vehicle brandished by Oklahoma’s finest (relatively speaking) SUV drivers, reduced to seven thousand bucks after fire, fraud, and corporate double-talk.

Now, Hudspeth isn’t just suing for breach of contract — the basic “you promised to cover my car, you didn’t” argument — he’s going nuclear with a bad faith claim. In Oklahoma, insurers have a legal duty to act fairly and honestly with their policyholders. They can’t play games, delay claims, or use shady third-party tools to lowball payouts. And according to Hudspeth’s lawyers, State Farm didn’t just mess up — they systematically undervalued his car using a methodology they knew was flawed. The petition even alleges that State Farm has been using CCC’s reports for years to “intentionally underpay total loss claims in Oklahoma to save many millions of dollars.” If true, this isn’t a mistake. It’s a pattern. A scam. A corporate strategy dressed up as “market valuation.”

So what does Hudspeth want? $74,500 — the maximum he’s willing to sue for. That includes compensatory damages (to cover the actual value of the car and his losses), attorney’s fees, and yes, punitive damages, because the court needs to send a message: you don’t mess with people’s livelihoods and then charge them for the privilege. Is $74,500 a lot? For a Range Rover? Not really. For a lawsuit against one of the largest insurance companies in America? It’s a rounding error — which is probably why they thought they could get away with it.

Here’s the thing we can’t get over: State Farm spent six months telling Hudspeth the car could be fixed, sent him money to fix it, then turned around and said, “Surprise! It’s totaled — and by the way, give us most of that money back.” That’s not just bad faith. That’s cartoon villain levels of corporate gaslighting. If Hudspeth had been a little less patient, a little less trusting, he might have looked like the bad guy. But the paper trail — the checks, the reports, the contradictory letters — tells a different story. It tells the story of an insurance company playing both sides of the field, and a regular guy caught in the middle.

We’re rooting for Hudspeth not because he owns a fancy SUV, but because he’s fighting for the principle: when you pay your premiums, you’re not just buying coverage — you’re buying trust. And State Farm, according to this filing, burned that trust right along with the Rover. Jury trial demanded? Absolutely. This one’s going to the people — and we’ll be watching with popcorn in hand.

A. Parties, Jurisdiction and Venue 1. Plaintiff Ryan Hudspeth is a citizen of the State of Oklahoma, residing in Jones, Oklahoma. 2. State Farm is a mutual insurance company licensed to do business as an insurance company in the State of Oklahoma. 3. State Farm delivered its automobile policy no. 4105651 – E22-36A (the "Policy") in question to Plaintiff Hudspeth in the State of Oklahoma. 4. State Farm conducts many millions of dollars of automobile insurance business in the State of Oklahoma. 5. This Court has jurisdiction over State Farm in this matter for the reasons that the injury occurred in this county and the amount in controversy in this action exceeds the jurisdictional minimum amount for this Court. B. Limitation of Damages 6. Plaintiff Hudspeth seeks to recover both compensatory damages and punitive damages for State Farm’s bad faith in this action. However, Plaintiff Hudspeth explicitly limits his claim for compensatory and punitive damages and also any claim for attorney’s fees, interests, and costs to an aggregate amount not to exceed $74,500. 7. Plaintiff Hudspeth does not claim or seek to recover monetary damages of any kind exceeding $74,500 in total. C. The Insured Vehicle 8. In May, 2025, Hudspeth owned a 2014 Range Rover vehicle (the “Rover”). 9. The Policy named Hudspeth as the insured and provided general liability and property damage coverage for the Rover. The Policy was in force on May 14, 2025. 10. On May 14, 2025, the Rover was rendered a total loss as a result of a fire. 11. The proper retail replacement value for the Rover is in excess of $22,000 (the “Replacement Value”). D. COUNT ONE - Breach of Contract 12. Plaintiff re-states and incorporates herein paragraphs 1-11 of this Petition. 13. State Farm has breached the Policy by failing to properly pay such Replacement Value to Hudspeth. E. COUNT TWO - Bad Faith 14. Plaintiff re-states and incorporates herein paragraphs 1-11 of this Petition. 15. Under Oklahoma law, a special relationship exists between an insurer and insured because of the unequal bargaining power between the insurer and the insured, and potential for the insurer to unscrupulously exert that power. 16. The special relationship creates a non-delegable duty of good faith and fair dealing owed by the insurer to the insured. 17. In addition to breach of contract, an insurer’s breach of this duty gives rise to a separate cause of action sounding in tort. 18. State Farm cannot avoid tort liability by purporting to delegate valuation of the Rover to a third party. 19. State Farm’s duty of good faith and fair dealing to Hudspeth includes the duty to timely and fairly investigate and value a total loss claim, to exercise good faith in all aspects of the claims handling process, and to timely and properly pay the total loss claim for the Rover. 20. The bad faith of State Farm involves multiple intentional and wrongful actions by State Farm. 21. First, State Farm failed to properly investigate the damage and loss to the Rover. 22. From May until November, 2025, State Farm intentionally wrongfully claimed that the damage to the Rover was repairable and failed and refused to declare the Rover a total loss. 23. Finally, nearly six months after the total loss of the Rover, State Farm sent Hudspeth a purported total loss valuation report prepared by the third-party CCC Intelligence Solutions, Inc. (the “CCC Report”) dated November 20, 2025. 24. A true and correct copy of the CCC valuation is filed herewith as Exhibit A. The CCC Report states a “vehicle base value” of $16,175, which understates the Replacement Value of the Rover by thousands of dollars. 25. After an inadequate upward condition adjustment of $1,026 and an improper and statistically invalid deduction for alleged prior damage, the CCC Report purports to state “adjusted vehicle value” in the amount of $15,201. 26. This CCC valuation is statistically invalid and has the specific intended purpose, known to State Farm, of improperly valuing this total loss to save State Farm thousands of dollars. 27. For many years, State Farm has had actual knowledge that the CCC valuation methodology is statistically invalid and systematically undervalues the fair replacement value of total loss vehicles insured by State Farm in Oklahoma. 28. State Farm has utilized CCC valuations for the wrongful and bad faith purpose of intentionally underpaying total loss claims in Oklahoma to save many millions of dollars. 29. CCC improperly told Hudspeth that the Rover was repairable. State Farm improperly delegated to Hudspeth the responsibility to deal directly with the repair shop and to pay the repair shop. State Farm sent Hudspeth two separate checks totaling $12,225.05 under two separate claim numbers for repairs. 30. In good faith, Hudspeth paid $6,421.06 of these proceeds to a repair shop, when State Farm knew or should have known the Rover was not repairable. 31. When Hudspeth finally realized that the Rover was not repairable, he properly retained the balance of the State Farm payment in the amount of $5,691.99. 32. State Farm’s bad faith becomes even more egregious. State Farm sent Hudspeth a letter dated December 9, 2025 (the “Letter”), which is filed herewith and incorporated herein as Exhibit B. This Letter incorporates the undervaluation of the Rover, based upon the CCC Report. 33. The Letter takes the intentionally wrongful and egregious bad faith action of deducting $8,468.03 from the amount payable for the total loss of the Rover. 34. In the Letter, State Farm sent Hudspeth a revised valuation offer to pay Hudspeth $6,983.76. 35. This offer deducts substantially all of the $12,023.05 payment which State Farm previously paid to Hudspeth. 36. This amount is apparently based on monies expended by State Farm during the period that State Farm wrongfully refused to declare the Rover as a total loss. 37. State Farm has also intentionally and wrongfully failed to pay a pro rata refund of Policy premium to Hudspeth. 38. State Farm’s conduct in failing to properly adjust the Rover total loss has been intentionally wrongful and in bad faith. Punitive damages are appropriate and fully justified under Oklahoma law to punish and deter State Farm with respect to such conduct in this case. WHEREFORE, Plaintiff Ryan Hudspeth respectfully demands compensatory damages, including interest, costs and attorney’s fees under Count One and punitive damages under Count Two in such amount as proof at trial may show, but not to exceed $74,500.00. CLAIM INSPECTION STATE FARM INSURANCE COMPANIES has provided CCC with the zip code where the loss vehicle is garaged, loss vehicle VIN, mileage, equipment, as well as loss vehicle condition, which is used to assist in determining the value of the loss vehicle. DATABASE REVIEW CCC maintains an extensive database of vehicles that currently are or recently were available for sale in the U.S. This database includes vehicles that CCC employees have physically inspected, as well as vehicles advertised for sale by dealerships or private parties. All of these sources are updated regularly. SEARCH FOR COMPARABLES When a valuation is created the database is searched and comparable vehicles in the area are selected. The zip code where the loss vehicle is garaged determines the starting point for the search. Comparable vehicles are similar to the loss vehicle based on relevant factors.
