She opened a credit account back in March 2022, likely with the same mix of hope and desperation that fuels most credit applications: maybe it was a car repair, a medical bill, or just groceries during a rough patch. The card was branded as an “Ollo Platinum” account, which sounds like a luxury product but was actually issued by The Bank of Missouri and later managed by Ally Bank. The interest rate? A cheerful 32.24%. That’s not a typo. Thirty-two point two four percent. If you’re doing the math, that’s more than triple what the average credit card charges. At that rate, your debt grows faster than mold in a damp basement.

The account went dark in late 2022 — no new purchases, no cash advances. But the balance didn’t vanish. By the time the last payment was made on July 26, 2023 — a modest $100 — the account was already in trouble. The statement from August 28, 2023, shows a balance of $3,165.67, with a minimum payment due of $477. That’s more than many people’s entire monthly rent. And here’s the kicker: the statement includes a warning in bold — “YOUR ACCOUNT IS AT RISK OF CHARGING OFF. PLEASE CALL US IMMEDIATELY.” But no call was made. No payment came. And on September 30, 2023, the bank pulled the plug. The account was “charged off,” meaning the bank wrote it off as a loss and moved on — or at least, they moved the debt somewhere else.

Enter Portfolio Recovery Associates, LLC — the plaintiff, the collector, the modern-day paper bounty hunter. These folks don’t lend money. They buy debt. Like vultures circling a very specific kind of financial carcass, they purchase defaulted accounts for pennies on the dollar and then try to collect the full amount. In this case, on December 5, 2023, Ally Bank sold Jessy Ferrell’s $3,165.67 debt to Portfolio Recovery in a bulk deal that likely included hundreds — maybe thousands — of other forgotten balances. The sale document is dry, corporate, and chilling in its efficiency. Jessy’s name, address, last payment date, and Social Security number are all listed in a spreadsheet titled “Ally Credit Card Debt Sale File 202310.xlsx.” She’s not a person anymore. She’s a row in an Excel file.

Now, fast-forward to January 27, 2026. Three years after the account opened, nearly two and a half years after the last transaction, and over two years after the last payment, Portfolio Recovery files a lawsuit in Woods County District Court. They’re not asking for forgiveness. They’re not offering a payment plan. They’re not even sending a strongly worded letter. They’re going straight for judgment — demanding $3,165.67, plus court costs, fees, and attorney’s fees. The legal claim? Breach of contract. Translation: “You agreed to pay. You didn’t. The original creditor — The Bank of Missouri — approved Jessy for a $3,000 credit limit despite what we can only assume were questionable financial circumstances. How we Calculate your Interest Charges Average Daily Balance Method (including new transactions): We figure the interest charge on your account by applying the “daily periodic rate” (DPR) to the “average daily balance”. The daily periodic rate is calculated by dividing the APR by 365. The average daily balance for Purchases, Balance Transfers and Cash Advance categories are calculated separately. To get the average daily balance we take the beginning balance of your Account each day, add to its respective category any new Purchases, Cash Advances, Balance Transfers, and/or applicable fees, and subtract payments and/or credits. This gives us the daily balance for each day, except that if the daily balance is negative, we treat it as zero. We then add up all of the daily balances for each category and divide by the number of days in the billing cycle. This gives us the average daily balance for each balance category. The interest charged for each balance category equals the average daily balance for that balance category times the applicable DPR times the number of days in the billing cycle. The result is then added together to determine the total interest charge for the billing cycle. To the extent interest comprises any part of your Average Daily Balance, compounding of interest will occur. When Interest Begins to Accrue on Purchases, Balance Transfers and Cash Advances: Interest on Purchases, Cash Advances and Balance Transfers accrues from the date of the transaction. If a transaction occurs in one billing cycle but is not posted to your Account until the next billing cycle, the transaction is added or subtracted on the first day of the billing cycle in which the transaction is posted to your Account. You will not have to pay interest on Purchases if you pay your New Statement Balance in full by the Payment Due Date shown on your statement, which shall not be less than 25 days after the close of the billing cycle. If you have been paying your Account balance in full and thereby avoiding interest on Purchases, but then do not pay the next New Statement Balance in full by the Payment Due Date, in that billing cycle we will start charging interest on the unpaid portion of your balance.
